Using your rights in practice
- Confirm your instrument: Identify whether a modern award and/or enterprise agreement applies, and locate its delegates’ rights term.
- Notify the employer: Ensure management/HR know you are the workplace delegate and how to contact you.
- Plan communications: Use reasonable times and methods (e.g., breaks, before/after work, agreed meeting slots) and keep records of consultations.
- Access facilities: Arrange reasonable access to rooms, noticeboards and electronic systems as permitted.
- Request training: Seek reasonable paid time to attend union delegate training.
- Escalate respectfully: If rights are obstructed, raise it in writing, refer to the instrument/Fair Work Act, and seek assistance.
