Protections for workplace delegates
Specific protections apply to prevent interference with a delegate’s role. Under s 350A of the Fair Work Act, an employer of a workplace delegate must not:
- Unreasonably fail or refuse to deal with the delegate;
- Knowingly or recklessly make a false or misleading representation to the delegate; or
- Unreasonably hinder, obstruct or prevent the delegate from exercising their rights.
In addition, general protections laws prohibit adverse action against a delegate because they perform their delegate role. Adverse action can include termination, threats of termination, disciplinary penalties, or detrimental changes to duties or hours.
