Recovery steps: demand letter & legal action
Step 1 — Write a letter of demand
- Set out what is owed, how you calculated it, and a deadline for payment.
- Professionals Australia’s Workplace Advice & Support (WAS) team can review your evidence/calculations and help draft the letter.
Step 2 — Initiate legal action (last resort)
- If the employer doesn’t rectify the underpayment, a legal claim may be filed to recover amounts owing (subject to the six‑year limit).
