Coverage, policies & where processes live
- Check your instrument(s): Look for a performance process in your policy, EA and sometimes your contract. EAs may set timelines, rights to representation and review/grievance avenues.
- National vs state systems: Most workplaces are in the national system (Fair Work). Some public sector/state system employers use their own policies or awards.
- Reasonable management action: A fair, genuine process to address performance is generally considered reasonable management action (separate from bullying).
