Who is covered & key definitions
- National system: Most employers and employees are covered by the Fair Work Act 2009 (Cth) and the NES maximum weekly hours.
- State systems: A limited group remain in state systems. Different arrangements can apply. Check which system covers your employment.
- Ordinary hours: Hours that are not overtime. For part‑time employees, the maximum weekly hours are their agreed ordinary hours if those are less than 38.
