Pathways to permanency (employee‑choice pathway)

Legacy pathway: Casual conversion by request remains for casuals in small businesses until 26 August 2025.

Employee‑choice pathway: Casual employees can apply in writing to become permanent by stating they no longer meet the definition of a casual.

Eligibility to apply

  • Not currently in a status dispute with the employer;
  • Employed for at least 12 months (small business) or 6 months (others); and
  • Have not received a status notice (about being casual/permanent) in the last 6 months.

How to apply (practical steps)

  1. Draft a short written notification explaining why you now meet the definition of permanent (e.g., regular pattern of hours, future work available, can’t refuse shifts).
  2. Send it to your employer (keep a record). If accepted, you’ll receive a new contract confirming permanent status.
