- Eligibility: Full‑time and part‑time employees accrue annual leave; casuals do not.
- Sources of rights: The NES sets the floor. Your award, enterprise agreement (EA) and/or contract may provide additional entitlements (e.g., leave loading, specific notice for shutdowns, cash‑out caps).
- Ordinary hours basis: Accrual is tied to ordinary hours (not overtime). Examples below illustrate how hours convert to weeks of leave.
- “Shift worker” (overview): The 5‑week entitlement applies only if the relevant definition is met. Common elements include a continuous shift roster operating 24 hours a day, 7 days a week, and the employee regularly working Sundays and public holidays. Where an award/EA defines “shift worker,” that definition usually applies.
