Possible outcomes, discrimination & adjustments

  • IME questions: Examiners are typically asked to identify any condition, whether it is temporary or permanent, and whether you can meet the inherent requirements (with or without reasonable adjustments).
  • Adverse findings: If you are found unable to perform the inherent requirements, the employer may consider termination, subject to any applicable enterprise agreement, legislation and reasonable adjustment obligations.
  • Is referral discriminatory or bullying? A referral grounded in a reasonable basis is generally not discriminatory. If you believe the referral lacks a reasonable foundation or is being used punitively, seek advice about bullying or general protections options.
