Fixed Term Contracts

From 6 December 2023, new Fair Work rules limit employers’ use of fixed term contracts (with exceptions). A fixed term contract ends after an identifiable period (e.g., set date, task or season). Contracts that started before 6 December 2023 aren’t directly covered, but still count when assessing whether a new contract offered on/after that date would breach the rules. Between 6 Dec 2023 and 1 Nov 2025, several industries are excepted; after 1 Nov 2025 the rules apply to all industries (subject to specific exceptions).
