Employers’ obligations: positive duty & WHS

  • Positive duty: Following Respect@Work reforms, employers and PCBUs must take reasonable and proportionate steps to prevent sexual harassment, sex‑based harassment, hostile work environments on the ground of sex, and victimisation.
  • Preventative controls: Policies, training, leadership, risk assessments for psychosocial hazards, safe reporting systems, and early intervention.
  • State/territory laws: Equivalent anti‑discrimination and WHS laws may also apply.
