  • Do I have to work? No — you can reasonably refuse an unreasonable request to work on a public holiday.
  • What if I’m rostered? A request can be made; if you work, penalties/TOIL usually apply under your instrument.
  • What if a public holiday falls on my day off? Typically no separate payment unless your instrument says otherwise.
  • What if I’m sick on a public holiday? It’s still a public holiday — not deducted from personal leave.
  • Can an employer substitute the day? Yes, if allowed by the instrument and usually with agreement.
