The Fair Work Act & the NES transitional provision
- The Fair Work Act does not create a uniform national LSL entitlement.
- Under the NES transitional provision, some employees continue to receive LSL in line with an applicable pre‑modernised award (a federal award in place before 1 January 2010).
- Employees not covered by a pre‑modernised award have LSL set by their state/territory legislation.
